Köylerin Mekânsal Planlama ve Tasarým Süreçlerinin Mevcut Mevzuata Göre Ýrdelenmesi

Kýrsal yerleþimlerin en önemli bileþeni olan köyler, kendine özgü yaþam biçimleri, arazi kullanýmlarý, sosyo-kültürel yapýlarý, doðal ve kültürel peyzajý, tarihsel olgusu ve mekân kurgusu ve kendine özgü doða ile iliþkili ekonomik kaynaklarý ile harmanlanmýþ mekânlardýr. Ülkemizde kýrsal mekânlara yönelik mevcut mevzuatýn günümüz ihtiyaçlarýný karþýlayamadýðý gibi içerik bakýmýndan yetersizliði ve karmaþýklýðý uzun vadede endiþe verici bir boyut aldýðý görülmektedir. Özellikle kýrsal alanlarýn sürdürülebilirliði açýsýndan kýrsal alanlarda izlenilen yasa ve politikalarýn deðiþmesini ve revize edilmesini gündeme getirmiþtir. Türkiye’deki köy yerleþimlerinin mekânsal planlama, tasarým ve yönetim süreçlerinde yaþanan eksiklikler ve sorunlar sosyal, kültürel, çevresel vb. pek çok sorunun temelini oluþturmaktadýr. Bu çalýþmada ülkemizin kýrsal yerleþimlerine yönelik kavramsal çerçevesi, mekânsal planlama ve tasarýma yönelik mevcut mevzuat (yasa ve yönetmelikler vb.) detaylý bir þekilde irdelenmiþtir. Sonuç olarak, kýrsal yerleþimler ve köylere yönelik mevzuatýn güncel, bütüncül, iliþkili ve ayrýntýlý olmamasý nedeniyle uygulamada farklý yorumlara ve çok yönlü sorunlara yol açmaktadýr. Bu nedenle kýrsal alan, kýrsal yerleþim ve köy ile ilgili kavramsal, mülki idari, yönetsel, mekânsal planlama ve tasarým boyutlarýnýn sürdürülebilir ve bütüncül olarak ele alýnmasý, gelecekteki ihtiyaç ve koþullara göre mevzuatýn revize edilmesi gerekmektedir.

Examination of Spatial Planning and Design Process of Villages According to the Current Legislation

Villages, which are the most important components of rural settlements, are places that are blended with their unique lifestyles, land uses, socio-cultural structures, natural and cultural landscape, historical phenomenon and space setup, and economic resources associated with their unique nature. In our country, the current legislation for rural areas cannot meet today's needs, and its inadequacy and complexity in terms of content have taken an alarming dimension over a long time. Especially in terms of the sustainability of rural areas, it has brought up the change and revision of the laws and policies followed in rural areas. The deficiencies and problems experienced in the spatial planning, design, and management processes of village settlements in Turkey are related to social, cultural, and environmental, etc. forms the basis of many problems. In this study, the conceptual framework of our country's rural settlements, and the existing legislation (laws and regulations, etc.) for spatial planning and design were examined in detail. As a result, because the legislation for rural settlements and villages is not up-to-date, holistic, relevant, and detailed, it causes different interpretations and multifaceted problems in practice. For this reason, it is necessary to address the conceptual, civil, administrative, managerial, spatial planning, and design dimensions of rural areas, rural settlements, and villages as sustainable and holistic, and the legislation should be revised according to future needs and conditions.
